In the current era of economic globalization, the competition for investment among governments and the increased influence of multinational enterprises have resulted in a concerning decline in the enforcement of fundamental social rights. This pressing issue necessitates immediate attention and action. It is crucial to promote the protection of fundamental social rights both at national and international levels as a means to humanize the face of economic globalization.
The Role of International Organizations and Soft Law
Currently, the responsibility for advancing social rights largely lies with international bodies such as the International Labour Organisation, the Organisation for Economic Cooperation and Development, and the United Nations. These organizations establish minimum labor standards focused on governments and enterprises. Unfortunately, due to a lack of political will, legally binding agreements that directly address the obligations of multinational enterprises remain scarce. Consequently, the implementation and recognition of social principles and standards throughout global supply chains heavily rely on soft law.
International Framework Agreements: A Path to Ensuring Labor Standards
Thankfully, a relatively recent instrument has emerged to empower global union federations in encouraging transnational corporations to uphold labor standards regardless of their operating locations. This instrument is the International Framework Agreements (IFAs). These agreements are established between a global union federation and a multinational enterprise to promote and protect fundamental social rights throughout the company's entire supply chain.
The Effectiveness of International Framework Agreements
Through thorough analysis of the addressees, content, follow-up measures, and binding effects of more than 60 concluded IFAs covering over 6 million workers worldwide, this study comprehensively examines the effectiveness of IFAs in ensuring labor standards across global supply chains. Furthermore, this study provides valuable recommendations to enhance the efficacy of these agreements.
